This Privacy Policy explains how Honor You Memorial Products ("Honor You", "we", "us" or "our") collects, uses, and protects information when you use our website, order our products, or use the guided memorial experience we provide through partnering funeral homes. By using our services you agree to the practices described here.
1. Information we collect
Depending on how you use our services, we may collect:
- Contact details such as your name, email address, mobile or landline phone number, and mailing address.
- Memorial information that a family chooses to provide, such as the loved one's name and dates, service details, an obituary, photographs, and keepsake or product selections.
- Order and payment details needed to fulfill and deliver products. Card payments are processed by our payment providers; we do not store full card numbers.
- Funeral home account details for our funeral home partners, such as business name, contact person, and branding.
- Usage information such as device type, browser, pages viewed, and general location, collected automatically as described in Section 5.
Much of the personal information we handle is provided to us by a partnering funeral home or by a family member acting on the family's behalf.
2. How we use information
We use the information we collect to:
- Design, produce, and deliver the memorial products and services requested;
- Provide the guided memorial experience, save progress, and let family members collaborate on a tribute;
- Communicate with you about an order, a proof to review, a service date, or a request for help;
- Send reminders, with consent, about details that are still needed for a memorial (see Section 3);
- Provide customer support and respond to enquiries;
- Operate, maintain, secure, and improve our website and services; and
- Meet legal, tax, and record-keeping obligations.
3. SMS text messaging & consent
Honor You may send SMS text messages related to a memorial, on behalf of the partnering funeral home. Our text messaging program works as follows:
- Opt-in. We only send text messages to people who have provided their mobile number and expressly agreed to receive texts, for example by opting in on a form or by a family member confirming consent when a case is set up with their funeral home. Consent is never a condition of any purchase.
- Types of messages. Messages are conversational and transactional, relating to a specific memorial. They include welcome messages, reminders about details or photographs still needed, notices that a proof is ready to review, and updates about an order. We do not send unrelated marketing or promotional text messages.
- Message frequency. Message frequency varies based on the memorial and what is still outstanding. You will typically receive a small number of messages during the period your memorial is being prepared.
- Cost. Message and data rates may apply, according to your mobile carrier plan.
- Opt-out. You can cancel at any time by replying STOP to any message. After you reply STOP, we will send one confirmation message and will not send further texts unless you opt in again.
- Help. Reply HELP for help, or contact us at info@honoryou.com or 973-744-7101.
- Carriers. Mobile carriers are not liable for delayed or undelivered messages.
Your mobile information stays private. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information may be shared with subcontractors who support our services, such as messaging and customer-service providers, solely to help us deliver the service to you. All other categories of use exclude text messaging originator opt-in data and consent, and this information will not be shared with any third parties.
4. How we share information
We do not sell your personal information. We share information only as needed to run our services:
- With the partnering funeral home connected to a memorial, so they can review and manage the family's tribute.
- With service providers who work on our behalf, such as printing and fulfillment partners, hosting and storage providers, email and SMS delivery providers, and payment processors. They may use the information only to perform services for us.
- For legal reasons, if required by law, regulation, legal process, or to protect the rights, property, or safety of Honor You, our customers, or others.
- In a business transfer, such as a merger or acquisition, subject to this policy.
As stated in Section 3, SMS opt-in and consent information is never shared with third parties for their own marketing.
5. Cookies & analytics
Our website uses cookies and similar technologies to keep the site working, remember preferences, and understand how the site is used. We may use analytics tools that collect standard log and usage data. You can control cookies through your browser settings; some features may not work correctly if cookies are disabled.
6. Data retention
We keep personal information for as long as needed to provide our services, fulfill orders, maintain business and financial records, and meet our legal obligations. When information is no longer needed, we take reasonable steps to delete or de-identify it.
7. Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security, but we work to protect your information and to limit access to those who need it.
8. Your choices & rights
You may:
- Ask us to access, correct, or delete personal information we hold about you;
- Opt out of text messages at any time by replying STOP, and opt out of marketing emails using the unsubscribe link;
- Contact us with any privacy question using the details below.
Depending on where you live, you may have additional rights under applicable privacy laws. We will honor those rights as required by law. To make a request, contact us using Section 11.
9. Children's privacy
Our services are intended for adults. We do not knowingly collect personal information from children under 13. If you believe a child has provided us information, please contact us and we will take appropriate steps to remove it.
10. Changes to this policy
We may update this Privacy Policy from time to time. When we do, we will change the "Last updated" date above. Significant changes will be reflected on this page, and your continued use of our services means you accept the updated policy.
