These Terms and Conditions ("Terms") govern your use of the website, products, and services of Honor You Memorial Products ("Honor You", "we", "us", or "our"). By using our website, placing an order, or using the guided memorial experience we provide through partnering funeral homes, you agree to these Terms. If you do not agree, please do not use our services.

1. Our services

Honor You designs, produces, and delivers memorial products and related services, including memorial stationery, keepsakes and gifts, signage and large-format prints, and digital tributes. We also provide a guided memorial experience that a partnering funeral home offers to families to gather the details, photographs, and selections needed to prepare these products.

2. Eligibility & accounts

You must be at least 18 years old to place an order or agree to these Terms. Families typically access the guided memorial experience through a private link provided by their funeral home, and no account or password is required. Funeral home partners and staff who receive an account are responsible for keeping their login details secure and for activity under their account.

3. Content you provide

You may provide content such as names, dates, an obituary, photographs, and instructions ("Content"). You represent that you have the right to provide that Content and to allow it to be used to prepare the requested products. You grant Honor You and the partnering funeral home a limited license to use, store, reproduce, and adapt the Content solely to design, proof, produce, and deliver the products and services you request. You are responsible for the accuracy of the Content, including the spelling of names and dates.

4. Orders, proofs & payment

Product descriptions, options, and prices are provided through your funeral home or at the time of order. An order is confirmed once accepted by us or the funeral home. Where a proof is provided, printing and production begin after the proof is approved. Please review each proof carefully, as we produce items based on the approved proof. Payment terms are as stated at the time of order and may be handled by the funeral home. Any applicable taxes and delivery charges will be added as shown.

5. Returns & refunds

Because memorial products are custom made and personalized, they generally cannot be returned or resold. If an item arrives damaged, defective, or not as approved on the proof, contact us promptly and we will work to correct it. Any separate returns or refund policy provided with your order applies in addition to these Terms.

You agree not to use our services to upload unlawful, infringing, or offensive content, to impersonate others, to interfere with or disrupt the services, or to attempt to gain unauthorized access to any part of our systems. We may suspend or decline service for content or conduct that violates these Terms or applicable law.

8. Intellectual property

Our website, designs, templates, layouts, graphics, and branding are owned by Honor You or our licensors and are protected by intellectual property laws. You may not copy, reproduce, or reuse them except for your own use of the products you order. Content you provide remains yours, subject to the license in Section 3.

9. Disclaimers

Our services and website are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website will be uninterrupted or error free. Slight variations in color, materials, or finish can occur in printing and production.

10. Limitation of liability

To the fullest extent permitted by law, Honor You and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of our services. Our total liability for any claim relating to a product or service will not exceed the amount you paid for that product or service.

11. Indemnification

You agree to indemnify and hold harmless Honor You and its owners, employees, and partners from any claims, damages, or expenses arising out of Content you provide, your use of the services, or your breach of these Terms.

12. Governing law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law rules. You agree that the state and federal courts located in New Jersey will have exclusive jurisdiction over any dispute arising from these Terms or our services.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date above. Your continued use of our services after changes are posted means you accept the updated Terms.
